This document is an electronic record in terms of the Information Technology Act, 2000 and rules made thereunder, as applicable, and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signature.

This document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, which require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of the domain name https://master-brains.com ("Website"), including any related mobile site and mobile application (together, the "Platform").

The Platform is owned and operated by Master-Brains, a proprietorship firm run by Raajesh S, with its registered office at B4M, Isha Aarambha Apartments, Mahatma Gandhi Road, Pirattiyur, Tiruchirappalli, Tamil Nadu – 620009 (hereinafter referred to as "Platform Owner", "we", "us", "our"). Master-Brains is a TN RERA-registered real estate sales & channel partner and consultancy firm (RERA Agent Registration TN/Agent/0297/2026).

Your use of the Platform and our services and tools are governed by the following terms and conditions ("Terms of Use") as applicable to the Platform, including any applicable policies which are incorporated herein by reference. If you make a payment on the Platform (for example, a site-visit or consultation booking fee, or a booking token/EMD towards a plot), you shall be subject to the policies applicable to that transaction, including our Refund & Cancellation Policy below. By merely using the Platform, you are contracting with the Platform Owner, and these Terms of Use, including the referenced policies, constitute your binding obligations with the Platform Owner. These Terms of Use relate to your use of our website and our real estate sales, channel-partner, and consultancy services (collectively, "Services"). Any terms and conditions proposed by you which are in addition to, or conflict with, these Terms of Use are expressly rejected by the Platform Owner and shall be of no force or effect. These Terms of Use may be modified at any time without assigning any reason; it is your responsibility to periodically review them to stay informed of updates.

For the purpose of these Terms of Use, wherever the context requires, "you", "your" or "user" shall mean any natural or legal person who accesses or uses the Platform.

ACCESSING, BROWSING OR OTHERWISE USING THE PLATFORM INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE, SO PLEASE READ THEM CAREFULLY BEFORE PROCEEDING.

The use of the Platform and/or availing of our Services is subject to the following Terms of Use:

1. To access and use the Services, you agree to provide true, accurate and complete information to us during and after registration or enquiry, and you shall be responsible for all acts done through the use of your registered account or enquiry submissions on the Platform.
2. Neither we nor any third parties (including the developers/sellers of the projects we promote) provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials offered on this website or through the Services, for any specific purpose. You acknowledge that such information and materials may contain inaccuracies or errors, and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law. Project specifications, pricing, availability, DTCP/RERA approval details and layout information are provided for general information and are subject to change — always confirm current details with our team before making any payment or commitment.
3. Your use of our Services and the Platform is solely and entirely at your own risk and discretion, for which we shall not be liable to you in any manner. You are required to independently assess and ensure that the Services meet your requirements, including carrying out your own due diligence on any property before making an investment decision.
4. The contents of the Platform and the Services are proprietary to us. You will not have any authority to claim any intellectual property rights, title, or interest in its contents, including but not limited to the design, layout, look, graphics and copy.
5. You acknowledge that unauthorised use of the Platform and/or the Services may lead to action against you as per these Terms of Use and/or applicable laws.
6. You agree to pay us (or, where applicable, the relevant developer/seller through us) the charges associated with availing the Services, including any booking token, EMD, or consultation/site-visit fee, in accordance with the applicable Refund & Cancellation Policy below.
7. You agree not to use the Platform and/or Services for any purpose that is unlawful, illegal or forbidden by these Terms, or by Indian or local laws that may apply to you.
8. You agree and acknowledge that the website and the Services may contain links to third-party websites (for example, project developers, TidyCal booking pages, or WhatsApp). On accessing these links, you will be governed by the terms of use, privacy policy and other policies of those third-party websites. These links are provided for your convenience and to provide further information.
9. You understand that upon making a payment for, or otherwise formally confirming, any of our Services (such as a booking token/EMD or a paid consultation), you are entering into a legally binding and enforceable arrangement with the Platform Owner (and, where applicable, the relevant developer/seller) for those Services.
10. You shall indemnify and hold harmless the Platform Owner, its affiliates and their respective officers, agents and employees, from any claim, demand or action (including reasonable attorney's fees) made by any third party or penalty imposed, due to or arising out of your breach of these Terms of Use, the Privacy Policy or other Policies, or your violation of any law, rule or regulation or the rights (including intellectual property rights) of a third party.
11. Notwithstanding anything contained in these Terms of Use, neither party shall be liable for any failure to perform an obligation under these Terms if performance is prevented or delayed by a force majeure event.
12. These Terms, and any dispute or claim relating to them or their enforceability, shall be governed by and construed in accordance with the laws of India.
13. All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Tiruchirappalli, Tamil Nadu.
14. All concerns or communications relating to these Terms must be sent to us using the contact information provided on this website, or in the Grievance Officer section below.

Privacy Policy

This Privacy Policy describes how Master-Brains and its affiliates (collectively, "Master-Brains", "we", "our", "us") collect, use, share, protect or otherwise process your information/personal data through our website https://master-brains.com (the "Platform"). You may browse certain sections of the Platform without registering with us. We do not offer any product/service under this Platform outside India, and your personal data will primarily be stored and processed in India. By visiting this Platform, providing your information, or availing any product/service offered on the Platform, you expressly agree to be bound by the terms of this Privacy Policy, the Terms of Use, and the applicable service/product terms, and agree to be governed by the laws of India, including those applicable to data protection and privacy. If you do not agree, please do not use or access our Platform.

Collection

We collect your personal data when you use our Platform, our services, or otherwise interact with us during the course of our relationship. This may include information provided during enquiry, registration, or use of our Platform, such as your name, date of birth, address, telephone/mobile number, and email ID, and/or any information shared as proof of identity or address. Some sensitive personal data may be collected with your consent, such as bank account, credit/debit card, or other payment-instrument information when you make a payment through our payment gateway partner (PhonePe), all in accordance with applicable law. You always have the option not to provide information by choosing not to use a particular service or feature on the Platform. We may track your behaviour, preferences and other information you choose to provide on our Platform; this information is compiled and analysed on an aggregated basis. We will also collect information related to your transactions on the Platform and with relevant third-party business partners (such as project developers or our payment gateway). When a third-party business partner collects your personal data directly from you (for example, PhonePe processing your payment), you will be governed by their privacy policy; we are not responsible for third-party privacy practices, and we request you to read their privacy policies before disclosing any information. If you receive an email or call from a person/association claiming to be Master-Brains and seeking any personal data like debit/credit card PIN, net-banking or mobile-banking password, please never provide such information, and report it immediately to an appropriate law-enforcement agency.

Usage

We use personal data to provide the services you request. To the extent we use your personal data to market to you, we will provide you the ability to opt out of such uses. We use your personal data to assist developers/sellers and business partners in handling and fulfilling bookings/enquiries; enhancing customer experience; resolving disputes; troubleshooting problems; informing you about offers, projects, services and updates; customising your experience; detecting and protecting against error, fraud and other criminal activity; enforcing our terms and conditions; and conducting marketing research, analysis and surveys. Your access to our Services may be affected if you do not provide the necessary permissions.

Sharing

We may share your personal data internally within our group/affiliated entities to provide you access to the services offered by them. We may disclose personal data to third parties such as project developers/sellers, our payment gateway partner (PhonePe), and other service providers, where necessary to provide you access to our Services, comply with our legal obligations, enforce our user agreement, facilitate marketing/advertising activities, or prevent, detect, mitigate and investigate fraudulent or illegal activities. We may disclose personal and sensitive personal data to government agencies or law-enforcement authorities if required by law, or in the good-faith belief that such disclosure is reasonably necessary to respond to subpoenas, court orders, or other legal process; to enforce our Terms of Use or this Privacy Policy; to respond to claims that content violates a third party's rights; or to protect the rights, property or personal safety of our users or the general public.

Security Precautions

To protect your personal data from unauthorised access or disclosure, loss or misuse, we adopt reasonable security practices and procedures, including use of a secure server for payments (via our PhonePe integration). However, transmission of information over the internet is not completely secure for reasons beyond our control, and users accept the inherent risks of data transmission over the internet when using the Platform. Users are responsible for protecting their own login and account credentials.

Data Deletion and Retention

You may write to us at the contact information below to request deletion, access, or correction of your personal data. We may delay or decline a deletion request where there is a pending grievance, claim, booking, or other service obligation. We retain personal data only for as long as is required for the purpose for which it was collected, or as required by applicable law, and may retain data in anonymised form for analytical and research purposes, or where necessary to prevent fraud or future abuse.

You may access, rectify, and update your personal data by contacting us directly using the details below.

Consent

By visiting our Platform or providing your information, you consent to the collection, use, storage, disclosure and processing of your information in accordance with this Privacy Policy. You consent to us (and our affiliates, technology and marketing partners, and business partners) contacting you through SMS, instant messaging apps (including WhatsApp), calls and/or email for the purposes specified in this Privacy Policy. You may withdraw consent already provided by writing to our Grievance Officer below, with the subject line "Withdrawal of consent for processing personal data". We may verify such requests before acting on them. Withdrawal of consent will not be retrospective and will be subject to the Terms of Use, this Privacy Policy, and applicable law; we reserve the right to restrict or deny Services where the withdrawn information was necessary to provide them.

Changes to this Privacy Policy

Please check this Privacy Policy periodically for changes. We may update it to reflect changes to our information practices, and will notify you of significant changes as required under applicable law.

Refund & Cancellation Policy

This policy outlines how you can cancel, or seek a refund for, an amount paid through the Platform via our PhonePe payment gateway. Master-Brains is a real estate sales, channel-partner and consultancy service — we do not sell or ship physical goods, so this policy covers amounts such as site-visit/consultation booking fees and booking tokens/EMDs paid towards a plot.

1. Site-visit / consultation booking fees — Cancellations will be considered if the request is made within 10 days of the payment, and before the scheduled visit/consultation has taken place. Once the visit or consultation has been completed, the fee is non-refundable.
2. Booking tokens / EMDs towards a plot — Cancellations will only be considered if the request is made within 10 days of placing the booking/making the payment. Cancellation requests may not be entertained if the specific plot/unit has already been formally blocked or allotted to you with the developer/seller on the basis of your payment, or if statutory/registration formalities have already commenced — in such cases, you may still raise the request and our team will check with the concerned developer/seller on your behalf.
3. If you believe an error occurred in the amount charged (for example, a wrong amount or a duplicate payment), please report it to our customer service team within 10 days of the transaction. We will verify the transaction with PhonePe and/or our records and take an appropriate decision.
4. Any project-specific commitments made by a developer (such as construction quality, timelines, or statutory approvals) are governed by your direct agreement with that developer, not by Master-Brains as the sales/channel-partner intermediary. Complaints of this nature should also be referred to the concerned developer.
5. Approved refunds will be processed back to your original payment source (via PhonePe) within 30 days of approval.
